Meet Elizabeth Stakenborg

Ms. Stakenborg limits her practice to representing Social Security Disability and Supplemental Security income claimants. She represents claimants from the initial level through the administrative hearing. Additionally, should the claim be denied, she also represents claimants at both the Appeal Council and in the United States District Court. She has attended numerous conferences regarding Social Security Disability issues and has spoken to various organizations and has authored articles with regard to the disability process.
She has also been involved in representing injured veterans in their appeals to the U.S. Court of Appeals for Veterans Claims through the veterans consortium Pro-Bono Program.
Prior to focusing on Social Security Disability, Ms. Stakenborg represented workers’ compensation claimants throughout central and north central Florida and has been involved in Appellate Proceedings as both appellee and appellant.
Liz is a member of the Florida Bar Assosciation, the American Bar Association, the Florida Trial Lawyers Association, the Association of Trial Lawyers of America, the National Organization of Veterans Advocates, and of the National Organization of Social Security Claimant’s Representatives (NOSSR). She is licensed in the US District Court - Northern District of Florida, US District Court - Middle District of Florida and the Court of Appeals for Veterans Claims.

Hello: I have a daughter (24) and stepdaughter (19-divorced father in ‘06). I receive SSD as of 9/01. I used Binder and Binder to appeal my case. I never received back money for the children. Binder was no help and said they my case records out, and too bad. Recently, on SS’s advice, I asked my daughter to go to SS to claim the five months’ benefits I never received from SS for my child’s benefits. SS told my daughter the money belongs to her, even though I supported her during that time she was under 18. She refuses to send me the money. What can I do? Thank you, Barbara
p.s. As for my stepdaughter, I have not had contact with her since I was granted a NY divorce on cruel and inhuman treatment from her father in ‘06. I never saw a penny of that back money from SS, either.

Unfortunately, I am not able to assist you with that matter. If the funds were sent to your daughter and she refused to give them to you, it is possible that you could file a claim in small claims court. You must be able to prove that you were entitled to those benefits rather than your daughter. It depends upon the type of benefits that were paid and the reason that they were paid for that time period.
