Social Security Disability and When to Apply

If you have a condition that is preventing you from working, you may be considering filing an application for Social Security Disability benefits. Social Security Disability (SSD) and Supplemental Security Income (SSI) are programs designed to provide income and medical benefits to people who are unable to work due to a serious medical condition. In order to be eligible for benefits, your condition must be expected to be disabling for a period of 12 months or more. It is important to file your claim within a year of your disability as SSD benefits are only payable up to one year prior to the date you applied. SSI benefits are payable as of the date of the application. I have had many clients wait for years to apply, only to learn that payments will not be retroactive to the date you stopped working or became disabled. You must be able to prove that your condition not only prevents you from performing the type of work you have done in the past, but depending upon your age, you must also prove that your condition prevents your from other types of work which may be less physically and/or mentally demanding. Ultimately, it is the decision of the Social Security Administration as to whether or not you are disabled, however it is very important to seek medical treatment and to make sure that your treating doctors are aware of how your condition has affected you.
