Migraines & Social Security Disability

I recently represented a claimant who was approved, in large part, due to migraine headaches that she had been suffering with for years. Eventually she became unable to work due to the severity of the headaches. When we spoke about the decision, she asked me if it was “normal” to be approved for benefits without a hearing based upon migraine headaches. The quick answer is “No.” Every single claim is unique and each claimant has certain impairments, education, work history and age all of which must be considered individually. In my client’s instance, her complaints of headaches were well documented and supported by the medical evidence of record. When the Administrative Law Judge reviewed the record and saw that the claimant’s statements regarding her limitations were supported by the evidence (including medical records prior to the date she last worked) the claim was awarded. I am extremely happy that the Judge reviewed the claim and granted benefits so my client was not forced to wait an additional 18 months for a hearing to be scheduled.
