Caregivers, family members, and rep payees should pay particular attention to this issue! Identity theft can be a particular risk for people who are disabled because of brain-based disorders. People with traumatic brain injuries, early-stage Alzheimer’s, other dementias, or autism spectrum disorders can all be more vulnerable to exploitation and scams than people whose cognitive functioning is intact. If memory is impaired, as in Alzheimer’s, or impulse control and attention are impaired, as in TBI, or social judgment is impaired, as in autism, schizophrenia, and many cases of TBI, the person will be more likely to fall for scams that can lead to identity theft.

Much identity theft occurs because a scammer gets information through “phishing”: calling and pretending to be your bank “confirming” your account details, or an email that looks as if it’s from a bank or credit card company directing you to a website that asks you to enter confidential information. Scammers get confidential financial information this way to sell your identity as a commodity on the black market. Those involved in caring for and managing the financial affairs of people who are disabled because of a brain-based disorder should monitor financial accounts regularly for evidence of identity theft. Help protect those who are most vulnerable.

Thank you so much for your question regarding back benefits.
Unfortunately, I am not able to assist you with that matter. If the funds were sent to your daughter and she refused to give them to you, it is possible that you could file a claim in small claims court. You must be able to prove that you were entitled to those benefits rather than your daughter. It depends upon the type of benefits that were paid and the reason that they were paid for that time period. I wish you the very best of luck and hope that you are able to get this issue straightened out.

Barbara in Tampa, FL

Hello: I have a daughter (24) and stepdaughter (19-divorced father in '06). I receive SSD as of 9/01. I used Binder and Binder to appeal my case. I never received back money for the children. Binder was no help and said they my case records out, and too bad. Recently, on SS's advice, I asked my daughter to go to SS to claim the five months' benefits I never received from SS for my child's benefits. SS told my daughter the money belongs to her, even though I supported her during that time she was under 18. She refuses to send me the money. What can I do? Thank you, Barbara

p.s. As for my stepdaughter, I have not had contact with her since I was granted a NY divorce on cruel and inhuman treatment from her father in '06. I never saw a penny of that back money from SS, either.

Thank you for contacting us regarding your Supplemental Security/food stamp issue. In Florida, these benefits are handled through the Department of Children and Families. You may contact them at 1-866-762-2237. With regard to the amount of your entitlement, because this is administered federally, your benefits should not change. However, you may contact the Social Security Administration at 1-800-772-1213 to determine whether your move will impact your benefits. Thank you for contacting us.
